01Problem
Discharge sets the bill, the status (inpatient vs. observation), the SNF three-midnight clock, and the charity-care window — while the patient is least able to read them. 2026 Part A deductible is $1,736 per benefit period; SNF days 21–100 cost $217/day; observation hours do not count toward the three-inpatient-midnight SNF rule. Nonprofit hospitals must run a FAP under IRC 501(r), yet families are told “we can’t help.” Medicaid can still pay bills from the three months before the application month for 2026 applications (42 CFR 435.915); that window shrinks Jan. 1, 2027.
02Intake
- Important Message from Medicare (CMS-10065), follow-up IM, Detailed Notice of Discharge (CMS-10066) if a QIO appeal was filed.
- MOON (CMS-10611) and any Medicare Change of Status Notice (MCSN) if inpatient was reclassified to observation.
- NOMNC if home health, SNF, hospice, or CORF is ending.
- Admission order, inpatient vs. observation note, expected discharge date.
- Insurance: Original Medicare, MA, Medicaid, Marketplace, commercial, uninsured; QMB/SLMB status.
- Household size, income, assets; whether the hospital is 501(c)(3), public, or for-profit.
- FAP, plain-language summary, AGB method, application, first post-discharge bill date.
- State of the hospital and of the patient’s residence.
- SNF/rehab/home-health plan and whether three inpatient midnights exist.
- Any collector letter or 30-day ECA warning.
03Playbook
- 01
Identify status before anyone leaves. Inpatient order vs. observation. Observation is outpatient: it does not start a Part A benefit period and does not count toward three consecutive inpatient midnights for SNF. If observation approaches 24 hours, demand the MOON (CMS-10611) — after 24 hours and no later than 36 hours, or sooner if discharged or admitted (42 CFR 489.20(y)). If inpatient is later reclassified to outpatient, ask for the MCSN and the QIO status-change appeal path after Alexander v. Azar.
- 02
Medicare discharge appeal — same day, before leaving. Deliver IM (CMS-10065) within two calendar days of admission and again not more than two days before discharge (42 CFR 405.1205). Appeal: call the BFCC-QIO printed on the IM, by midnight of the planned discharge date and before leaving (42 CFR 405.1206). Phone is enough. Coverage continues (except ordinary deductible/coinsurance) until noon the calendar day after the QIO notifies its decision. Hospital then delivers DND (CMS-10066). If the QIO agrees with the hospital, continued-stay liability starts at that noon. Miss midnight → standard (non-expedited) review; continued-stay coverage is not guaranteed.
- 03
Reject “we can’t help, you’re uninsured.” EMTALA still requires a medical screening exam and stabilizing treatment in a dedicated ED regardless of ability to pay. After stabilization, money is billing. Ask PFS, social work, and the case manager — by name — for Medicaid screening, FAP, and a collections hold.
- 04
Apply for Medicaid immediately, including for a deceased or incapacitated patient. SSA 1902(a)(34) / 42 CFR 435.915: eligibility no later than the third month before the application month if the person received covered services and would have been eligible — including if no longer alive. Stay Nov. 10–18, 2026; application Feb. 5, 2027 (under 2026 three-month rule) reaches November. File in 2026 if you can. P.L. 119-21 §71112 (July 4, 2025) shortens retroactivity for applications on/after Jan. 1, 2027: one month for ACA expansion adults; two months for everyone else (CMS WFTC deck, Nov. 2025). Dec. 31, 2026 keeps three months; Jan. 2, 2027 does not. Ask the hospital to hold and recode to Medicaid.
- 05
Apply for the FAP even if insured. 26 CFR 1.501(r)-4: every 501(c)(3) hospital organization must have a written FAP covering emergency and medically necessary care, publicize it (website, ED/admissions copies, LEP translations at 5%/1,000), and state AGB and ECAs. Eligibility is income-based, not uninsured-only. Copays/deductibles are often FAP-eligible — read that FAP. For-profits are outside 501(r); CA, NY, WA, IL, MD still impose statutory discounts on many or all licensed hospitals.
- 06
Know the 501(r) clocks. ECAs: sell the debt, report adverse credit, deny/defer medically necessary care because of a prior unpaid bill, legal process (lien, foreclosure, bank seizure, civil action, arrest, wage garnishment). Not ECAs: bankruptcy proof of claim; lien on PI-settlement proceeds. No ECA during 120 days from the first post-discharge bill; 30 days before the first ECA, written notice naming the ECAs, deadline, FAP plain-language summary, plus a reasonable oral FAP notice. Hospital must process a FAP application filed within 240 days. Complete application suspends ECAs. If approved: cap at AGB, refund amounts paid above FAP price if >$5, reverse ECAs. Incomplete: say what is missing and give reasonable time.
- 07
AGB is the federal ceiling for FAP-eligible emergency/medically necessary care. Look-back insurer sets (1.501(r)-5): Medicare FFS alone; Medicare FFS + all private insurers; or Medicaid alone or combined. Medicare Advantage is not Medicare FFS for look-back. Prospective: bill as Medicare FFS or Medicaid would allow. No federal FPL floor; 230% FPL is a common hospital choice, not a 501(r) requirement. State floors override if more generous.
- 08
Stack state charity care on top of 501(r). Use the more generous of the hospital FAP and the state statute. NY and WA apply to insured patient-responsibility. CA AB 2297: no monetary-asset test except HSA. NY: immigration is not an HFAL criterion; uniform application. IL 210 ILCS 89 is uninsured-only.
- 09
SNF/rehab is a status problem. Without three inpatient midnights, Original Medicare will not pay the SNF. Options: stay inpatient (QIO appeal), pay privately, use Medicaid, or go home with home health (NOMNC appeal if that is ending). IM/QIO still applies to MA inpatient discharges.
- 10
QMB dual-eligibles cannot be balance-billed for Medicare deductibles, coinsurance, or copays. A QMB billed the 2026 Part A deductible ($1,736) is an unlawful bill.
- 11
Hill-Burton is rare. HRSA listed 126 obligated facilities as of Dec. 12, 2024; many states have zero. Typical free care ≤100% FPL. Apply at the facility: https://www.hrsa.gov/get-health-care/affordable/hill-burton/facilities.
- 12
Apply on every bill, every episode. 240-day clock is per episode (aggregation uses the most recent first bill). Birth admission, later ED, professional anesthesia can each need a FAP application.
- 13
Payment plans are not a substitute for FAP. File FAP first; remainder then goes on an interest-free plan. An $80,000 bill on $100/month with a later FAP write-off is a possible outcome, not a plan.
- 14
After discharge, freeze collections while Medicaid and FAP pend. Written dispute + FAP + Medicaid case number to PFS and any collector. A 501(c)(3) that reports credit or sues inside 120 days, or that refuses a timely FAP application, is outside 1.501(r)-6.

05Questions to ask
- Q01
Am I inpatient or observation, and will you put the admission order and the MOON/IM in my hands before I leave?
- Q02
Planned discharge date, and the BFCC-QIO name and phone on my Important Message from Medicare?
- Q03
Does this stay include three inpatient midnights for SNF, or only observation hours?
- Q04
Have you screened me for Medicaid, Marketplace, and your FAP? Application, plain-language summary, and AGB percentage today.
- Q05
What FPL cutoff is free vs. discounted in your FAP, and do you apply it to copays and deductibles?
- Q06
Will you hold billing and withhold ECAs for 240 days while I apply for FAP and Medicaid?
- Q07
If I am a QMB, confirm you will not bill me the Part A deductible or coinsurance.
- Q08
For [CA/NY/WA/IL/MD], apply the state statutory discount, not only your FAP.
- Q09
If inpatient is reclassified to observation, when do I get the MCSN and how do I appeal that to the QIO?
06Red flags
“We don’t have charity care” at a 501(c)(3) hospital.
FAP limited to “the uninsured” when the written policy covers medically necessary care more broadly.
Observation billed as if it created SNF eligibility.
IM never delivered, or delivered on the way out with no time to call the QIO.
MOON missing after >24 hours of observation.
Collector, suit, or credit report before day 120 or without the 30-day ECA letter.
FAP refused inside 240 days.
QMB billed the $1,736 Part A deductible.
CA charity screening using monetary assets other than HSA (barred, AB 2297).
NY hospital asking immigration status as an HFAL criterion.

09Formulas & rules
- 2026 Part A (CMS, Nov. 14, 2025): deductible $1,736/benefit period; days 61–90 $434/day; lifetime reserve $868/day; SNF days 21–100 $217/day; SNF 1–20 $0 after a qualifying hospital stay. Example: 8-day inpatient, first 2026 benefit period, no Medigap → $1,736. 25-day SNF after 3 inpatient midnights → 5 × $217 = $1,085.
- IM / QIO: request by midnight of discharge day, still in hospital. Pause until noon the day after the QIO decision. Discharge planned Thursday; QIO decides Saturday → if unfavorable, patient-pay starts Sunday noon.
- MOON: observation >24h → notice by 36h. Observation Monday 10:00 a.m. → MOON due Tuesday 10:00 p.m.
- Medicaid retro (2026 apps): third month before the application month. June 2026 app reaches March–May. On/after Jan. 1, 2027: expansion adults 1 month; others 2 months (P.L. 119-21 §71112; CMS WFTC PDF). Expansion adult, November 2026 stay, January 2027 app → only December is retro; November is lost. Same stay, December 2026 app → November is in.
- 501(r) 120/240: first post-discharge bill Dec. 1, 2026 → no ECA before March 31, 2027; FAP through July 29, 2027.
- 2026 FPL family of 4 (48 states): $33,000. 200% = $66,000; 300% = $99,000; 400% = $132,000; 500% = $165,000; 600% = $198,000.
- California (HSC 127405): ≤400% FPL ($132,000/4) → cannot charge more than the greater of Medicare or Medi-Cal. No Fair Pricing Act application deadline; 501(r) 240-day floor still applies at nonprofits. AB 2297: no monetary assets except HSA.
- New York (PHL 2807-k, from Oct. 20, 2024): <200% FPL ($66,000/4) → **waive all**. 200–300% uninsured → max **10% of the Medicaid payment**; underinsured → max 10% of insurance cost-sharing. 301–400% → **20%**. Underinsured = OOP >10% of income. Example: Medicaid would have paid $8,000; uninsured family of 4 at 250% FPL ($82,500) → collect at most $800.
- Washington (RCW 70.170.060, care on/after July 1, 2022): applies to patient-responsibility, insured or not. Tier 1 (system with 3+ acute hospitals, or >300 beds in King County, or >200 beds in a ≥450,000-resident southern-border county): 100% free ≤300% FPL, 75% off 301–350%, 50% off 351–400%. Tier 2: 100% free ≤200%, 75% off 201–250%, 50% off 251–300%. Example: Tier 1 family of 4 at $90,000 (273% FPL) → 100% free patient-responsibility.
- Illinois 210 ILCS 89 (uninsured): Non-rural family of 4 at $50,000 (152% FPL) → 100% charitable discount on medically necessary hospital services >$150. Same family at $120,000 (364% FPL) → discount to 135% of cost (factor
1.0 − (CCR × 1.35)), 12-month collections capped at 20% of income = $24,000. Rural/CAH: 100% only at ≤125% FPL for services >$300; discount only to 300% FPL. Apply within 90 days of discharge/service/screening/public-insurance denial (89/15). Physician bills are outside HUPDA. Live ILCS is 20%/90 days; older Illinois Hospital Report Card pages saying 25%/60 days are stale. - Maryland HG 19-214.1 / HSCRC FAP schedule: ≤200% FPL → free medically necessary hospital care (may update within 240 days of the initial bill). MD DSD COMAR Title 10 Subtitle 37 FAP content: 201–250% FPL → 75% OOP reduction; >250% through 300% → 60%. Hardship reduced-cost below 500% FPL (hospital medical debt over 12 months >25% of family income, excluding copays/coinsurance/deductibles). Uninsured 200–500% → income-based payment plan. Assets: only monetary assets over $100,000; retirement accounts excluded. From Oct. 1, 2025 (HB 268 / SB 981): no civil action for ≤$500, no suit during the 240-day FAP window, no CRA reporting of hospital medical debt, no primary-residence lien or foreclosure. Maryland is all-payer: non-charity uninsured bills are HSCRC-approved rates, not chargemaster. COMAR 10.37.10.26 as currently published is the working-capital payer-discount rule, not FAP.
10State variation
- Federal 501(r) unchanged 2025–2026. 240-day period and ECA definition remain 26 CFR 1.501(r)-6.
- Medicaid retro cut is statutory for applications on/after Jan. 1, 2027 (P.L. 119-21 §71112). 42 CFR 435.915 still stated three months as of mid-Oct. 2026; the statute controls 2027 applications.
- NY HFAL expansion Oct. 20, 2024 to all DOH-licensed hospitals.
- WA DOH charity-care rulemaking: CR-102 July 30, 2026, supplemental CR-102 Oct. 20, 2026 (WSR 26-21-270); hearing Dec. 1, 2026. RCW 70.170.060 already in force for care on/after July 1, 2022.
- MD HB 268 / SB 981 and HB 1020 Oct. 1, 2025.
- CA AB 2297 / SB 1061 Jan. 1, 2025; SB 1061 amended by AB 1521 eff. Jan. 1, 2026.
- IL HUPDA: 90-day apply (89/15); 20% income cap (89/10(c)).
- 2026 FPL (91 FR 1797) used 11 months of 2025 CPI-U because October 2025 CPI-U was missing during the shutdown.
11Community tactics
- “Apply for the hospital Medicaid ASAP” / work the discharge team on rehab — Verified. 42 CFR 435.915 retroactivity and presumptive eligibility; SNF/rehab turns on inpatient status.
- Nonprofit hospitals must have a FAP; “it’s based on income, not just no insurance” — Verified. 26 CFR 1.501(r)-4.
- “Apply for financial assistance every time we get that hospital bill” — Verified. 240-day clock is per episode.
- $80,000 birth bill on $100/month, then FAP “covered the rest” — Partly. Possible if FAP was approved later; sequence is FAP/Medicaid first. Dollar outcome is anecdote.
- $52,883.32 broken-arm X story — Dropped (unverified; mechanism not shown).
